Relocation

As the prevailing approach of most authorities in the OECD is to prioritise ‘substance over form’, it is imperative that new arrangements are set up correctly. Physical presence in addition to place of management and control have become decisive considerations for the vast majority of tax rulings.
When moving a family to a new country, a methodical approach is warranted. The integrity of such arrangements is likely to be scrutinised by tax authorities of both the previous and current places of residence. It is therefore important that sufficient ‘substance’ is established with physical premises and staff rather than merely a mailing address. Liechtenstein is ideally suited as it is centrally located near Zürich and has affordable office space for a dedicated management office. As a AAA-rated part of the European Economic Area, the Principality is not considered a tax haven and has banks with the lowest counterparty risk of any trust jurisdiction in the world. Liechtenstein does not recognise foreign civil judgments apart from those of Switzerland and Austria, which can be helpful in the context of matrimonial disputes, succession planning and frivolous litigation.
